Access to land is essential for the successful operation of energy and mining projects. However, there are often social, environmental and economic issues associated with acquiring land for these projects. Socially, many people are relocated; economically, local communities are not given adequate compensation; environmentally, pollution negatively impacts on the agricultural and fishing industries relied on by over 80% of the local communities. Against this stark background, and drawing from the author's fieldwork research, this book addresses the important question of whether the different land tenure systems, coupled with administration and registration procedures, are adequate to address the increasing land disputes in oil and mineral-rich African countries.

While current efforts to increase transparency and accountability in the management of natural resources emphasize the roles and responsibilities of a broad range of actors, relatively little attention has been paid to the potential contribution of elected legislators. Yet, the three core functions of legislative bodies - representing constituent interests, making or shaping public policy, and overseeing policy implementation by executive branch agencies - are central to any effort in this area. This report is an effort to help elected political officials - particularly those in the legislative branch of government - serve as constructive leaders in improving the oversight and management of their countries' natural resources.

The potential for using revenues from extractive resources for inclusive growth in Africa is tremendous. However, the realisation of the transformative role that extractive industries could play in sustainable development has been elusive in most African countries. Extractive industries in most of these countries are plagued with numerous conflicts, some with serious casualties over the control, distribution, management and utilisation of the resources and revenues from extractive operations. Collaborative Governance in Extractive Industries in Africa presents the critical challenges facing extractive industries from different contexts, countries, sectors and settings. It features chapters with diverse angle of interest and analytical tools applied in examining the critical issues related particularly to mining and petroleum development in Africa. The contributors to this book have extensive academic and professional experience in policy research in the mining, oil and gas sectors in Africa and other regions. The book addresses the current gap in knowledge about appropriate governance regimes that could create the forum where the divergent interests and positions of various stakeholders of extractive resources and revenues could be handled - without any of them resorting to deadly conflicts. It presents the functionality of collaborative governance in enhancing for example, transparency, accountability, and equitable distribution of extractive revenues. Governance practitioners, policy- and decision makers could use the structures, components and procedures discussed in this book to develop training manuals, governance criteria and indicators for measuring and managing collaborative governance regime at the national and local levels. They will also find useful information about some of the critical elements that should guide the strategic implementation of the collaborative process.

Regulatory variability in sub-Saharan Africa is based on the push and pull of domestic elite-driven governance orientations, including post-conflict and constitutional transitions, populist and local community political pressures, especially as electoral competition becomes a political reality, transnational influences, networks, and impositions, and competing discourses about the role and objecti. [...] The interplay of governance orientations, institutional pillars and competencies, and regulatory objectives and approaches creates a complicated web for policy-makers and stakeholders who aspire to leverage resource riches for socio-economic development. [...] Fourth, the rise of China and other extractive industry actors changed the landscape of investment: strategic agreements, non-market-based calculations of investment thresholds, and ready access to cheap equity and debt financing via government-backed banks and export credit agencies reduced dependence on Western capital markets. [...] If value maximization and mitigation objectives were the focus of the past 20 years, a swing of the pendulum back to the catalyzation of structural economic transformation objective characterizes the contemporary era of extractive industries in sub-Saharan Africa. [...] Both the content of new regulations and the uncertainty generated by substantive changes to the rules of the game will keep the risk averse away and attract only the strategic players and high-risk speculators.

This book explores the various issues that characterise the African mining sector, drawing examples from different African countries and regional organisations. Although there is a massive literature on the subject, some issues have been neglected, including the crucial role of digitalisation and technological advancement in resolving the environmental and social challenges faced in Artisanal and Small-Scale Mining (ASM), deep-sea mining, mining contract negotiations and modernising mining laws to reflect the increasing role of critical minerals, to mention but a few. Therefore, the book unpacks the critical issues associated with the mining sector, explicitly reflecting on the practical solutions needed to address the challenges in the African mining sector.
