Civil, economic, political and social rights are at the centre of the concept of European citizenship. In this volume, the focus is on the political-constitutional dimension of European citizen­ship, which is discussed from the perspective of several disciplines – history, constitutional law and political science. It provides a multi-faceted account of the evolution of European citizenship and its institutionalization, explaining why certain rights came into existence at a certain time and focussing on several key actors involved, such as the European Court of Justice.

This book is open access under a CC BY 4.0 license. This Open Access book investigates European citizenship after Brexit, in light of the functionalist theory of citizenship. No matter its shape, Brexit will impact significantly on what has been labelled as one of the major achievements of EU integration: Citizenship of the Union. For the first time an automatic and collective lapse of status is observed. It is a form of involuntary loss of citizenship en masse, imposed by the automatic workings of the law on EU citizens of exclusively British nationality. It does not however create statelessness and it is likely to be tolerated under international law. This loss of citizenship is connected to a reduction of rights, affecting not solely the former Union citizens but also second country nationals in the United Kingdom and their family members. The status of European citizenship and connected rights are first presented. Chapter Two focuses on the legal uncertainty that afflicts second country nationals in the United Kingdom as well as British citizens, turning from expats to post-European third country nationals. Chapter Three describes the functionalist theory and delineates three ways in which it applies to Brexit. These three directions of inquiry are developed in the following chapters. Chapter Four focuses on the intension of Union citizenship: Which rights can be frozen? Chapter Five determines the extension of Union citizenship: Who gets to withdraw the status? The key finding is that while Member states are in principle free to revoke the status of Union citizen, former Member states are not unbounded in stripping Union citizens of their acquired territorial rights. Conclusions are drawn and policy-suggestions summed up in the final chapter.

The process of European integration has had a marked influence on the nature and meaning of citizenship in national and post-national contexts as well as on the definition and exercise of civil rights across Member States. This book uses a theoretical and empirical approach to explore the philosophies of European citizenship and European identity. The author applies a focused analytical framework to argue that European identity and citizenship should be perceived as postmodern categories which are multi-layered, dynamic and fluid. The book offers a detailed review of political and legal studies which do not comprehend or explain postmodernist concepts of citizenship and identity. In the theoretical part of the book various philosophical models of citizenship and identity (from antiquity to the postmodern era) are portrayed, and the author's own theory and analytical framework is developed. The empirical part of the book discusses a variety of case studies illustrating how European Union policies apply to this framework.

The book proposes a new approach to constitutional analysis of the EU and its legal framework, arguing that the existence of constitutional rights norms within EU law enables this particular legal order to respond effectively to societal and political challenges within the rigidity of constitutionalism. Providing new perspectives on constitutionalism in the EU, this book considers the way the Court of Justice of the European Union (CJEU) discusses and applies the EU citizenship Treaty norms by analysing the courts approach to decision making, which resembles the balancing and weighing of conflicting principles.

This book examines the changing character of European citizenship, focusing on 'acts' of citizenship.

Over the last two decades, the process of European integration has become interwoven with the theme of citizenship and the debate on the democratic quality of the EU and of its institutions has become more salient. What are the views about Europe which emerge when we interrogate the national elites of the four large South European countries, Greece, Italy, Portugal, Spain and what is their vision of a supra-national citizenship in its different facets? Are these views sufficiently homogeneous and do they distinguish themselves from those of the rest of the European Union to the point of enabling us to talk about a "distinctive region of Europe"? Which interpretation(s) of European citizenship emerges from a systematic exploration of these opinions? Using a set of survey and textual data collected in the framework of the IntUne project, the authors attempt to provide some original answers to these questions. This book was published as a special issue of South European Society and Politics.
