Dynamism in Sino-Japanese relations, of which the Diaoyu/Diaoyutai Islands dispute constitutes a major part, has greatly overshadowed not only prospects of positive collaboration between China and Japan, but also regional order in East Asia. On the surface, the essence of the dispute focused on sovereignty, which entails competition for maritime resources development and strategic access to the adjacent waters as a critical transportation and military route. What lies at the crux, however, is the conflict between different sets of values, which lead and shape their interpretations of international treaties, changes of governments, and impacts of this upon these Asian states’ attitudes toward how “sovereignty” and “territory” should be understood in contemporary Asia. The Diaoyu/Diaoyutai Islands dispute has lapsed into dormancy, since intense discussions in the period from 2010 to 2012. However, the disagreement is far from being resolved. This book draws on structural issues underlying the on-going dispute, along with the concomitant, multifaceted challenges that need to be investigated. General international law is part and parcel of investor-state arbitration. This is the case not only regarding treaty law and state responsibility, but also with respect to matters such as state succession, the international minimum standard, and state immunity, all of which feature regularly in investor-state arbitration. Yet, although general international law issues arise in almost every investment case and often require extensive research, no systematic exploration of the relationship between the two exists. This Commentary is the first to fill this gap, providing a comprehensive treatment of the role of general international law in international investment law. It engages in detail with central matters of general international law, including in the practice of investment arbitration tribunals, moving beyond existing works which focus solely on procedural and institutional provisions. The Commentary's forty-six chapters do not focus on a single source or subject. Instead, each concentrates on a specific, relevant article from a particular source of public law - such as the Vienna Convention on the Law of Treaties (1969) or the International Law Commission's Articles on the Responsibility of States for Internationally Wrongful Acts (2001), among others. The entries combine detailed analysis with an examination of procedural and substantive aspects - such as nationality and unjust enrichment - and respond to the following questions: how have investment tribunals interpreted and applied the specific rule of general international law? To what extent and why does such interpretation and application align with or deviate from the practice by other international courts or tribunals? How could and should investment tribunals interpret and apply rules that have yet to feature in investment arbitration? This unique format means this commentary will serve as a central guide for all relevant case law and scholarship on international investment law.

Today's hearing will cover China's maritime disputes in the East and South China Seas. We'll examine the security, political, legal, and economic drivers of these disputes in our three panels today. The first panel will begin by discussing the broad security situation on the high seas. As China's maritime forces have become more capable over the past decade, Beijing has become more confident in its ability to assert its claims in the disputed areas. Beyond China's "hard" security concerns, however, other domestic, political, and legal elements shape China's policy in the East and South China Seas. Our second panel will consider popular nationalism as one of these elements. It has become a key driver of Chinese foreign policy as personality politics in Beijing has given way to a collective leadership seeking Party legitimacy. We'll conclude with a panel on how resources and economic drivers shape China's maritime disputes. Security of China's near seas is critical to the unimpeded flow of trade and imported energy resources. Though the natural resources in the East and South China Sea undoubtedly shape the security landscape, there appears to be a debate on the centrality of oil and gas resources to the dispute.

Uneasy Partnerships presents the analysis and insights of practitioners and scholars who have shaped and examined China's interactions with key Northeast Asian partners. Using the same empirical approach employed in the companion volume, The New Great Game (Stanford, 2016), this new text analyzes the perceptions, priorities, and policies of China and its partners to explain why dyadic relationships evolved as they have during China's "rise." Synthesizing insights from an array of research, Uneasy Partnerships traces how the relationships that formed between China and its partner states—Japan, the Koreas, and Russia—resulted from the interplay of competing and compatible objectives, as well as from the influence of third-country ties. These findings are used to identify patterns and trends and to develop a framework that can be used to illuminate and explain Beijing's engagement with the rest of the world.

Japan's China Policy understands Japan's foreign policy in terms of power - one of the most central concepts of political analysis. It contributes a fresh understanding to the subject by developing relational power as an analytical framework and by applying it to significant issues in Japan's China policy: the negotiations for a bilateral investment protection treaty and the disputed Pinnacle (Senkaku/Diaoyu) Islands. Hagström demonstrates that Japan exerted power over China in such divergent empirical settings for the most part by using civilian instruments positively, defensively and through non-action. Given that Japan's foreign policy is often portrayed rather enigmatically in terms of power, the unique contribution of Japan's China Policy is to demonstrate how to analyze power aspects of Japan's foreign policy in a more coherent fashion. This revealing approach to Japan's foreign policy will be of huge interest to anyone studying Japanese politics, foreign policy or international relations.
