This book addresses the form of these effects, outlining the social, political and economic problems created by the free movement of people within the European Union. The eminent European contributors to this book explore the ways in which nation states and the EU seek to promote the benefits of migration but at the same time counter threats arising from dislocation. The advantages and costs of migration are considered, as is the crucial problem of who gains and loses from migration. This book examines the management of migratory flows in the Mediterranean within an international security perspective. The intense migratory flows registered during the year 2015 and the tragedies in the Mediterranean Sea have tested the mechanisms of the Union’s immigration and asylum policies and its ability to respond to humanitarian crises. Moreover, these flows of varying intensities and geographies represent a threat to the internal security of the EU and its member states. By using Spain and Italy as case studies, the author theorizes that the EU, given its inability to adopt and implement a common policy to effectively manage migratory flows on its Southern border, uses a deterrence strategy based on minimum common denominators.

This open access book adopts a rights-based approach to shed light on the different legal and policy instruments that have been developed to implement circular migration policies in the EU, and their consequences for the rights of migrant workers. It contributes to the understanding of the meaning of this concept in general and in the EU, as well as specifically regarding its Eastern neighborhood. The book provides a comprehensive picture of the formation and implementation of the EU’s circular migration approach that has developed through both EU and national instruments, on the basis of comparative case study analysis of Bulgaria and Poland’s migration laws and policies. By applying empirical legal research methods, it draws conclusions about the policy outcomes from the implementation of the various migration instruments falling under the circular migration umbrella and shows the consequences for the rights of migrant workers as a result of the application of different policy options. This book analyzes the externalization of the EU’s immigration and asylum practices towards non-member transit countries and the consequences of this process. Selected policy areas of externalization (border management, visa policy, readmission agreements and asylum policy) are applied to Turkey and Morocco as two main migration transit countries within two different institutional cooperation mechanisms: Turkey as an EU candidate country within the EU’s enlargement policy; Morocco without membership prospect within the EU’s neighborhood policy. Yıldız applies theoretical debates and critically compares the rhetoric in policy papers with practice in the field.
