Excerpt from Factory Children: Report Upon the Schooling and Hours of Labor of Children Employed in the Manufacturing and Mechanical Establishments of Massachusetts To His Excellency William Gaston, Governor of the Commonwealth of Massachusetts. Sir: - There are in this Commonwealth upwards of sixty thousand children, of school age, who are growing up in ignorance, contrary to the ancient policy of the State, and in open violation of the letter and spirit of existing laws. To protect and provide for this vast and increasing body of illiterates, the legislature of 1867 authorized "the constable of the Commonwealth to specially detail one of his deputies." The Hon. Henry K. Oliver, of Salem, was the first appointee, serving two years, and making two official reports. In August, 1869, the duties of the office were assigned to Capt. J. Waldo Denny. After the establishment of the police commission, in 1871, no officer was detailed, but the following instructions were given to each member of the force: - "Constables of the Commonwealth will, as far as practicable, ascertain by interviews with children employed, by examination of school certificates, or other evidence, if there is a compliance with the provisions of the law. Your attention is called to the statute of 1867. "Officers will not Incur extra expense in making investigations under the foregoing law, unless upon reliable and positive information of a violation of its provisions, when they will act as in any other criminal matter." Upon the abolition of the police commission, it became the duty of the chief constable to detail an officer for this work.
