Excerpt from Equity and Its Remedies This book is the outcome of lectures delivered by the author at the Evening Law School of the Boston Y. M. C. A. And at the Law School of Boston Univer sity, on the equitable remedies. The justification for putting the material in this form is found in the expressions of gratitude from former students who have been good enough to say that they have found in these lectures citations and statements of principles inaccessible in any text-book. The frequency with which the author has turned to these notes for cita tions in his own practise has convinced him that others of the profession may be able to find assistance from the same source. The book is an attempt to give a rational outline of equity (exclusive of trusts and kindred subjects) and to show the scope of the equitable remedies. It does not attempt to deal with strictly statutory subjects or with equity pleading or practice. While the citations are largely drawn from Massa chusetts cases (and Ames's Cases on Equity), it is believed the subject is treated in such a way as to make the book of general application, useful to the student or practitioner in any part of the United States. No attempt has been made to cite all the equity cases decided in Massachusetts, although cer tain parts of the subject, not covered by existing text-books, have been treated with thoroughness. Between one-third and two fifths of the text has been omitted, and the greater part of the notes; all except/ such as seemed essential to a clear understanding of the text. No part of the text has been re-written. By the sacrifice of some details of comparatively little importance to the American student (as in the chapters on Election, Satisfaction, and Perform ance, 461 of matters peculiar to the jurisdiction in individ ual states (as in 299 and by the free use of cross references (e. G., see 70-88, 151 it has been found possible to preserve intact those full discussions of the foundation and rationale of the various equitable doctrines which are the chief excellence of the work. The index (with some regret) has been greatly shortened; on the other hand, the chapter analyses have been retained without omissions, for the purpose of showing the author's full scheme of treatment of the various subjects. Excerpt from Equity in Pennsylvania From the Historical Point of View But in England there grew up, by reason of circum stances peculiar to that country, a special system or code of rules, administered by a separate court,2 and co - exist ing with a different set of rules on the same subjects, ad ministered by other courts. This system is what is des ignated by the third sense of the term equity. And it created certain rights, not recognized at law, but consti tuting the specific grounds upon which applications for equitable relief are based. These rights are known as equitable rights or equities, and the fourth sense in which the word is used is that which it bears when em ployed to designate such a concrete equitable right.
