Excerpt from Elements of the Law of Agency A volume of selected cases to accompany the text is in preparation, and will shortly appear. The desire to keep the volume within as small a compass as possible made it inexpedient to give references to parallel series of reports in the foot notes, but this defect has been in part remedied by printing such references in the table of cases.viii preface. It were ungrateful not to acknowledge the debt owing to previous writers On this subject. The works of Mr. Justice Story, Mr. Wharton, Mr. Evans and his American editor, Mr. Ewell, and the more recent work of Mr. Mechem, have been of the greatest assist ance, and are among the permanent treasures of our legal literature. It is hoped that this little volume may serve to introduce the student to an important branch of the law of obligation which he will pursue further in these works of the masters. Excerpt from Cases on the Law of Agency Zl'hs following collection of cases has been prepared, at the request of several leading educators, to accompany the writer's treatise on the law of agency, the purpose being to illustrate the text by object lessons gathered from the reports. Nothing in the way of annotation has been attempted, beyond an occasional refer ence to similar cases, as it is thought that the text of the treatise supplies all that is needed in that direction. To make a selec tion of cases from the great number upon the subject is a difficult task and one in reference to which opinions will necessarily difier. The attempt here has been to select such as contained clear state ments of the principles or furnished striking illustrations of them, and were not too much involved with other matters or too long for reproduction. Boms cases which might otherwise have appeared have been omitted because the substance of them has been sufii oiently stated in the text or notes of the treatise. In many cases matters irrelevant to this subject have been omitted. Cases on the law of master and servant have also been omitted, as they suficiently appear in other available collections. Many of the cases given are too recent to constitute what may be termed lead ing oases, nor has there been any attempt to include all that might properly be so designated. As the volume is intended primarily for the use of students, for whom the making of their own abstracts is a most valuable exercise, the cases are printed with out head notes. It is believed, however, that they will be thereby rendered no less useful to others who may desire to consult them, as a full index furnishes a ready guide to their contents. Acknowledgments are especially due to Professor Francis M. Burdick, of Columbia College, who kindly volunteered to furnish. Excerpt from Cyclopedia of Law, Vol. 4 It is not contemplated that the reader or student will find in the present book all that is contained in the well known text-books upon these sub J ects. Larger or more comprehensive books are not necessary to answer the purpose intended by the volumes of the Cyclopedia of Law. It is only the aim and purpose of the Series to furnish in convenient and inviting form the principles and elements of the American law. Under the head of Contracts it has not been attempted to discuss the various special contracts, which are now considered as distinct legal subjects. Sales, Bailment, Negotiable Instruments, Agency, etc., are treated in later numbers of the Series. The discussion has been limited to the method of making a complete and binding contract, with a consideration of the essentials of such a contract; determining the effect of such a contract when made; the method of interpreting or construing the terms of the contract; and, finally, when and how the contract is terminated.
