Examines the ethical dilemma of whether, and how, archaeologists and other experts should work with the military to protect cultural property in times of conflict. The world reacted with horror to the images of the looting of the National Museum in Iraq in 2003 - closely followed by other museums and then, largely unchecked, or archaeological sites across the country. This outcome had been predicted by many archaeologists, with some offering to work directly with the military to identify museums and sites to be avoided and protected. However, this work has since been heavily criticised by others working in the field, who claim that such collaboration lended a legitimacy to the invasion. It has therefore served to focus on the broader issue of whether archaeologists and other cultural heritage experts should ever work with the military, and, if so, under what guidelines and strictures. The essays in this book, drawn from a series of international conferences and seminars on the debate, provide an historical background to the ethical issues facing cultural heritage experts, and place them in a wider context. How do medical and religious experts justify their close working relationships with the military? Is all contact with those engaged in conflict wrong? Does working with the military really constitute tacit agreement with military and political goals, or can it be seen as contributing to the winning of a peace rather than success in war? Are guidelines required to help define roles and responsibilities? And can conflict situations be seen as simply an extension of protecting cultural property on military training bases? Berenika Drazewska’s book offers a comprehensive scholarly analysis of the current meaning of military necessity in the international legal framework for the protection of cultural heritage during armed conflicts.

It is widely acknowledged that all archaeological research is embedded within cultural, political and economic contexts, and that all archaeological research falls under the heading ‘heritage’. Most archaeologists now work in museums and other cultural institutions, government agencies, non-government organisations and private sector companies, and this diversity ensures that debates continue to proliferate about what constitutes appropriate professional ethics within these related and relevant contexts. Discussions about the ethics of cultural heritage in the 20th century focused on standards of professionalism, stewardship, responsibilities to stakeholders and on establishing public trust in the authenticity of the outcomes of the heritage process. This volume builds on recent approaches that move away from treating ethics as responsibilities to external domains and to the discipline, and which seek to ensure ethics are integral to all heritage theory, practice and methods. The chapters in this collection chart a departure from the tradition of external heritage ethics towards a broader approach underpinned by the turn to human rights, issues of social justice and the political economy of heritage, conceptualising ethical responsibilities not as pertaining to the past, but to a future-focused domain of social action.

The world responded with horror to ISIS's campaign of destruction of cultural heritage across the Middle East, including with calls for an international response to prevent such damage. At the same time, newspapers and screens were filled with images of human destruction, devastated cities,and thousands of refugees fleeing the conflict. This juxtaposition caused a backlash against those voicing their concerns about the destruction of ancient ruins, popularly framed as dispute about 'stone versus lives'. In the face of so much human suffering, it can seem inappropriate to worry aboutanything but the urgent, basic needs of people.Heritage and War addresses this issue within the context of a wider debate, amidst a range of moral questions. Eleven original essays investigate a variety of philosophical and moral questions arising from the phenomenon of heritage destruction in war, such how we ought to respond to heritage thatis damaged in war, the nature of the harm caused by such damage, and the morally appropriate treatment of sites of war and conflict that have themselves become heritage sites. Such issues are philosophically rich, and yet they have been largely neglected by academic philosophers. This book makes asubstantial contribution to developing this new philosophical territory and identifying the role that philosophers have to play in developing our understanding of and responses to these important issues.

This book focuses on the balance between protecting human rights and protecting world heritage sites. It concerns itself with the idea that the management of heritage properties worldwide may fail to adequately respect traditional entitlements and rights of individuals and communities living within or being affected by changes in the use of these spaces. It also explores the concept that the international heritage field has limited knowledge and awareness of this challenge. The volume argues that the dilemmas in question result from different conceptualisations of the key terms of 'rights', 'heritage' and 'community' among different groups and across political and cultural boundaries. In so far as 'culture' is what enables us to read the meanings involved, the ultimate questions are those that ask whose power is contested when one meaning is ‘fixed’ and the heritage of one group of humans is given the right to have its symbolic representation enjoyed and protected. The fate of heritage in war has attracted considerable attention in recent years, due in no small part to ISIS's campaign of destruction across the Middle East and, in 2012, the International Criminal Court's first prosecution of heritage destruction as a war crime. Regular armed forces have been criticised for both failing to protect and damaging heritage sites. In response, heritage organisations urge the better implementation of existing international laws on heritage protection in war. This book argues that any such law or policy will require combatants to choose between safeguarding heritage and safeguarding other goods, including human life. It thus challenges the view, repeatedly expressed by heritage professionals, that the choice between protecting heritage and protecting lives is a false dichotomy. Existing international law not only implies such choices but also, more worryingly, gives no indication of how they should be resolved. Drawing on contemporary work on the ethics of war, this book develops an account of the permissible protection of heritage in war. It argues that heritage is not morally special; rather, heritage is one of many goods that contribute to individuals' lives going well and that we routinely trade off against each other. By drawing on these more familiar dilemmas, we can make progress on how to balance the protection of heritage against risks to human life. Amongst other things, the book considers the different ways in which heritage might contribute to individual flourishing, the role of consent in justifying the imposition of risk on combatants and civilians, the permissibility of forcefully defending heritage and what, if anything, could compensate for the loss of heritage in war.
